Terms and Conditions
General Conditions of Assistance Service
- A – This Technical Assistance service (Phone Safe®) undertakes to repair the equipment unless:
- The IMEI or other identification code has been removed, erased, defaced, altered or is otherwise illegible, as determined by the brands.
- One or more components required for your repair are no longer manufactured by the brand or are out of stock for a long time.
- The equipment has been opened, altered or repaired by persons outside of Authorized Technical Assistance Centers and/or unauthorized components have been used during its repair.
- B – Collection of the equipment depends on the presentation of the “Repair Ticket” document and, where applicable, payment for the repair.
- C – Phone Safe® is not responsible for backing up your device's data. Data may need to be completely erased during the repair.
- D – Whether for repairs or replacements, components that are technically considered new may be used.
Budgets
- A – In cases of repair of equipment that, due to the passage of time, is no longer covered by the Manufacturer’s Limited Warranty or whose faults are not covered by the conditions of that same Warranty, but provided that the equipment complies with the “general conditions” announced here, this Repair Center will not issue a prior quote when the repair concerns faults corresponding to a maximum repair value of €15 VAT Inc.
- B – Upon notification of the fault, duly signed by the Customer, this Repair Center is authorized to repair the equipment up to a maximum value of €15 VAT Inc.
- C – In cases of repair of equipment that meets the conditions mentioned in point A, but where the repair cost is greater than €15 VAT Inc., this Repair Center will issue a quote for approval by the Customer.
- D – Once the estimate has been issued and approved, it may be subject to change if the fault finally identified by the Repair Center does not match the one initially detected. In such cases, the Repair Center will inform the Customer of the changes to the initial estimate and wait for approval before carrying out the repair.
- E – Any and all quotes (including any changes to the initial quote) are valid for one week. If the Customer does not respond after this period, the quote will be deemed not to have been accepted.
- F – Once the repair process has been completed, or if there has been no intervention on the equipment because the quote has not been accepted or the repair has proved impossible, the collection of the equipment by the customer is subject to the conditions set out below in “Deadline for collection of equipment”.
- G – Under no circumstances will the issuance of a quote be considered as a guarantee of the effective repair of the equipment, which, in certain cases, may prove impossible.
Deadline for collecting equipment
- A – The equipment must be collected within a maximum period of 30 (thirty) days after the Customer is notified of the completion of the respective intervention.
- B – The Repair Center will notify the Customer, in person (if the Customer is in the store), or by telephone or written message, of the completion of the repair process of the equipment delivered by the customer, for the purpose of its timely collection.
- C – If there is any payment required by the Customer, this will be made when the equipment being repaired is collected.
- D – After this period, whether for repairs under the Manufacturer's Limited Warranty or for repairs excluded from the same, the Customer will have an additional period of 30 (thirty) days to collect the equipment and pay the repair invoice (if applicable), and will also be obliged to pay, for each day of this additional period and up to the date of actual collection, a penalty of €1.00 (one euro), up to a maximum of €30.00 (thirty euros).
- E – After 60 (sixty) days have elapsed from the first notification made by the repairing entity, without the Customer having collected the equipment and without having communicated and proven the existence of force majeure reasons, the aforementioned repairing entity ceases to be responsible for any damage or even possible loss or misplacement of the equipment and, furthermore, reserves the right to take the equipment delivered for repair as its own, as compensation for the expenses inherent to the process, which the Customer, from now on, expressly accepts, authorizes and qualifies as a “pro solvendo” dation.
Purpose and scope of application
3.1. These General Terms and Conditions of Sale exclusively regulate the purchase and sale made in the Phone Safe online store, between the Customer as buyer and Phone Safe as Seller, and apply to all visitors to the website www.phonesafe.pt, as well as to any commercial transaction carried out through this virtual online store.
3.2. Browsing the website, as well as purchasing any product at www.phonesafe.pt, implies acceptance of these general conditions of use and contracting.
3.3. Phone Safe sells all products in the Phone Safe collection and will be the entity responsible for selling items from various brands on the website www.phonesafe.pt, with all e-commerce services being available only to end consumers.
3.4. “Customer” or “User” is considered any person who acts or purchases for a purely personal or professional purpose.
3.5. Phone Safe reserves the right to change these terms of use and contracting, without prior notice, as well as to modify at any time the information and commercial offer presented on products, prices, promotions, commercial conditions and services, and any change will always be published on the website www.phonesafe.pt.
3.6. Phone Safe reserves the right not to process any order received from users who are not Customers or those that do not comply with the general terms and conditions of sale.
3.7. The Customer must provide the Phone Safe online store with an email or postal address, or details relating to another form of contact, that are correct and complete and accepts that Phone Safe may contact him/her using these details, if deemed appropriate.
Information about the contents of the Phone Safe online store
4.1. The website www.phonesafe.pt is intended for private use only, therefore the reproduction, transfer, distribution or storage of the contents of the Phone Safe online store, without prior written authorization, is prohibited for any purpose other than strictly personal use.
4.2. The introduction of website links for commercial purposes or without prior authorization from Phone Safe is expressly prohibited, as is the use of the domain www.phonesafe.pt for abusive purposes, without prior authorization, which will be subject to recourse to the competent legal means by Phone Safe.
4.3. In the event that links are found on other websites that allow access to www.phonesafe.pt or references to the Phone Safe Lda online store, we inform you that Phonesafe, Boutique Lda has no responsibility for the links or pages, nor for the content contained therein.
4.4. The information presented on www.phonesafe.pt will, in principle, be free from typographical errors, and whenever these occur, Phone Safe will correct them as soon as possible.
4.5. All contractual information is written in Portuguese, as is the information on the articles, email communications and formalization of the sale, with the exception of expressions that are very specific to certain products.
Commercial Policy
5.1. If the information presented does not correspond to the characteristics of the product, the Customer has the right to terminate the purchase and sale contract under applicable legal terms.
5.2. The photographs presented on the website are merely illustrative, so it is recommended that the Customer carefully consults the product details for better information and understanding of the respective characteristics of the items they wish to purchase.
5.3. Product prices and specifications are subject to change without notice. Despite Phone Safe's utmost care in keeping all information up-to-date, some products may have incorrect prices. Therefore, prices will be verified whenever orders are processed. If the product price is lower than the advertised price, the difference will be refunded to the Customer. If the price is higher, the Customer will be notified by email. Phone Safe will await the Customer's decision to accept the new offer or cancel the order.
5.4. The Phone Safe online store's product catalog is independent of the physical stores, both in terms of price, product selection, and stock quantity. All promotional campaigns have limited stock and may be exclusive to the Phone Safe online store.
5.5. Validation of the purchase order or request assumes that the Customer is aware of and accepts the general terms and conditions of sale of the website www.phonesafe.pt.
5.6. All data recorded by Phone Safe constitutes proof of the set of transactions carried out between Phone Safe and the Customer, and it is Phone Safe's responsibility to archive the electronic document in which the contract is formalized, and to keep it accessible.
Obligations of Customers and Users
6.1. Any visitor to the website www.phonesafe.pt is obliged to comply with and respect these general conditions, in particular by observing the following obligations:
It is prohibited to introduce, store or disseminate through the Phone Safe online store defamatory, obscene, insulting, xenophobic and/or any other content that violates the general principles of law and public order;
Save, and do not disclose, your website login password in order to prevent third parties from accessing your account and personal data;
Do not use false identities;
Provide your personal data and correct addresses so that Phone Safe can properly process orders;
6.2. The Customer is solely responsible for the veracity of the personal data communicated to Phone Safe and undertakes to immediately enter and inform any changes to data through their registration account at www.phonesafe.pt
6.3. Phone Safe is not responsible for any delay or inability to process the order, resulting from an error or insufficiency of the data communicated by the Customer, particularly at the time of delivery.
Placing an order online
7.1. To place an order at www.phonesafe.pt, the Customer must have a valid and frequently used email account.
7.2. To place an order at www.phonesafe.pt the Customer must:
Browse the online store pages and find the products you want to purchase;
Add your preferred products to the shopping cart using the “Add to Cart” or “Order” button;
Once you understand that you have chosen all the items you wish to purchase, complete the purchase by clicking on “Finalize Purchase” in the shopping cart;
Fill in your personal details on the form, paying particular attention to the accuracy and completeness of your address and email address;
Select shipping method;
Select payment method;
Review your order;
Proceed to payment, confirming the order.
7.2. As soon as the purchase is complete, the Customer will receive an automatic email confirming the transaction. It is recommended that you print or download a copy for future reference.
7.3. In the event of non-confirmation of payment or non-compliance with these General Terms and Conditions of Sale, Phone Safe reserves the right not to accept the order, or to cancel it in whole or in part, even after automatic confirmation.
Product availability and order confirmation/cancellation
8.1. Phone Safe only processes an order placed by the Customer after confirmation of the respective payment, and therefore cannot guarantee the availability of the items until the beginning of said processing.
8.2. Phone Safe only ships orders on business days. Therefore, weekends and holidays are not taken into account when estimating delivery times. Any delay in shipping items, compared to the estimated delivery dates, does not entitle the Customer to compensation.
Order confirmation or cancellation
9.1. Phone Safe may not validate an order that does not have sufficient guarantee of payment, when the order is incomplete or incorrect, or when the products ordered are no longer available. In any of these cases, Phone Safe will inform the Customer via email that the sales contract will not be completed and the sale will not proceed, specifying the reasons.
9.2. If the products ordered on www.phonesafe.pt are no longer available at the time of your last access to the website, despite having received order confirmation, or when Phone Safe receives the order, the Customer will be informed about their unavailability, never exceeding the period of 30 days after receipt of the order.
9.3. If an order has been placed, and payment has been made, for products that have since become unavailable, Phone Safe will refund the amount paid for the unavailable items.
9.4. Phone Safe reserves the right to refuse any order, for any reason, and is exempt from liability for any damages or costs. It also reserves the right to cancel any purchase, even if it has already been accepted or confirmed, in particular in the following situations:
It is found that the information on the invoice is not correct or verifiable;
It is found that the order is flagged by the website's Security Systems as an incorrect, irregular order, or an order susceptible to fraud;
It is found that the transfer of the amount for payment of the order has not been received within a period of 5 working days following the acceptance of your order;
It is impossible to deliver the order to the address provided by the Customer;
It is considered that the Customer did not have the capacity to make the purchase.
If there is an error in the presentation of the product price;
Payment conditions and security guarantees
10.1 Available payment methods will be displayed at www.phonesafe.pt. No other payment methods other than those mentioned will be accepted.
In case of attempted payment through any means other than those indicated, Phone Safe cannot be held responsible for the loss of payment, or any other damages that may arise.
10.2. The Customer may pay for products using a credit card, personal PAYPAL account, bank transfer or Multibanco.
10.3. For payments made using credit cards, all details (such as card number, expiration date, or security code) will be sent via encrypted protocol to the company providing remote electronic payment services, PAYPAL, without third parties having access to the transmitted information. This information will not be used by the Phone Safe online store, except to carry out the necessary transactions for purchases or refunds, in the event of returns pursuant to the exercise of the right of return, or to report suspected fraud to the authorities.
10.4. The purchase price of the products and the shipping costs, as indicated in the order form, will be charged to the current account when the purchased products are actually shipped.
Security of the Phone Safe online store and all transactions
11.1. The Phone Safe online store uses the latest and most robust security technologies available for encryption platforms. All payment information provided by the Customer will be encrypted from the initial moment of the transaction until the order is processed and will not be stored on any public server.
11.2. Phone Safe shall not be liable for any damage suffered as a result of the use of electronic means of communication, in particular damage resulting from failures or delays in the delivery of electronic communications, interceptions or manipulations of electronic communications by third parties or by computer programs used for communications or virus transmissions.
Reservation of Ownership of marketed products
Phone Safe retains ownership of the company's products until it has received full payment for all such products.
Prices
13.1. The prices of the products displayed on the website contain/include Value Added Tax (VAT).
13.2. Shipping fees are calculated per order. The exact shipping fee will depend on the country to which the order will be delivered. For additional information on shipping fees by country, please see the "Shipping" section of the website.
13.3. All prices are quoted in euros. Changing the delivery country may affect prices due to shipping costs.
13.4. The total price specified in the final checkout menu includes taxes and shipping costs. Prices are quoted at the time of order confirmation.
13.5. The Customer must pay only the exact amount specified in the order confirmation and make individual payments per order.
13.6. Product prices displayed on the website are subject to change. Phone Safe reserves the right to change product prices without prior notice, prior to the purchase being finalized. The prices displayed at the time of purchase are the prices currently applied to that purchase.
Quality and Guarantee
14.1. Phone Safe does not sell second-hand, defective, or inferior-quality products. The main features of each product listed at www.phonesafe.pt can be found on each product page.
14.2. The products offered for sale at www.phonesafe.pt may not exactly match the actual garment in terms of image and colors, due to the Internet browser and monitor used.
14.3. All products have an identification label, which cannot be removed if the Customer wishes to return the purchased product. If the Customer decides to exercise the right to return the purchased products, Phone Safe reserves the right to refuse returns of products returned without the label, or that have been altered from their original condition, or are damaged.
Shipping of products and deliveries
15.1. Products are delivered Monday through Friday, from 9:00 a.m. to 6:00 p.m. No deliveries are made on certain holidays.
15.2. Delivery of an order can only be completed if the delivery address is a home, office or delivery point in the countries available for delivery.
For the Customer to receive the order, it is necessary to ensure that someone is at the address. This service does not include scheduling or appointment options, so the order will be delivered without prior contact from the carrier. Phone Safe does not guarantee this delivery time during promotions, sales, Christmas, or when out of stock.
15.3. A delivery is deemed to have been made or a product is deemed to have been delivered upon signature of the delivery receipt at the agreed address.
15.4. If the Customer confirms the order on a business day before 12:00 p.m. and pays by Credit or Debit Card, or via MbWay and Paypal, the order will be shipped the next business day (weekends and holidays are not considered business days). If the Customer chooses to pay by ATM reference or bank transfer, shipping will only be made after receipt of payment, which may take between 5 and 7 days.
15.5. Phone Safe shall not be liable for any failure to perform, or delay in performing, any obligation due to a force majeure event, that is, an event, act, or omission beyond its reasonable control. A force majeure event means any event, act, or omission beyond Phone Safe's reasonable control.
15.6. Phone Safe reserves the right to split the delivery of the order, for example (but not limited to) if part of the order is delayed or unavailable. If the order is split, the Customer will be notified by email of this circumstance. For this purpose, the email address provided by the Customer at the time of purchase will be used.
15.7. Upon delivery, the Customer must inspect the packaging for any damage. If the Customer finds the products damaged, they should not accept delivery of the order, which will be returned. Phone Safe will refund the amounts paid for the order and shipping as soon as the warehouse receives and completes the return process.
Any complaint regarding non-receipt of an order must be made within a maximum period of 30 days from the date of order confirmation. After this period, Phone Safe cannot be held responsible for lost or lost orders.
Shipping costs
16.1. Shipping fees apply to each order. The exact shipping price depends on the delivery country. For more details on shipping prices by country, please see the Shipping section of the website.
16.2. If the Customer places an order whose value exceeds the minimum order value defined for their country or campaign, shipping will be free of charge.
Returns and cancellations
10.1. The Customer may cancel the order, as long as it has not yet been shipped. If the Customer places an order and wishes to cancel it, they must contact our Customer Service and request cancellation by emailing phonesafelda@gmail.com.
If the cancellation request is successful, the Customer will be notified of this decision by email, and the cancellation will be processed at no cost to the Customer. If the cancellation request is unsuccessful, the products will be sent to the Customer. If the Customer still intends to cancel the order, they must refuse to accept the products. The products will be returned, and upon receipt, a refund for the returned items will be processed.
Orders for customized products cannot be canceled before shipping, as the customization process is already underway, starting immediately after the order is received.
10.2. The Customer has the right to return delivered products if they are found to have defects or other non-conformities with the products ordered. Returns may be made within 30 days of the Customer receiving the order. If the Customer's complaint is deemed justified, the price and shipping costs will be refunded. For more information on how to proceed with returns and information on refunds, please consult the "Exchanges and Returns" menu on the website.
10.3. If for any reason the Customer is not satisfied with the products they ordered, they may return them within 30 days of receipt, provided that:
The products have not been washed or used (unless the product contains information to the contrary, the Customer has the right to try on the clothes and shoes to test the size and shape, but cannot wear them);
The product maintains its original characteristics and the packaging is not damaged (carefully opened packaging will not be considered damaged);
The product is complete (e.g. both items of a pair must be returned);
The following cannot be returned:
Products that have been adulterated;
Customized products.
10.4. A person who has received a product as a gift from another person cannot return it. In this case, to return the product, the person who purchased it (i.e., the Customer) must contact the person who purchased it so that they can process the return in accordance with the Return Conditions.
10.5. To exchange items for others or to change sizes, please follow the steps described in the “Exchanges and Returns” section.
10.6. If your return is justified by a defect or non-conformity with the products ordered, Phone Safe will bear the shipping and return costs. If your return is made for reasons other than a justified defect or non-conformity with the products ordered, Phone Safe will not reimburse the shipping costs.
Refunds will be processed via bank transfer. Customers must provide their bank details (IBAN and SWIFT code) to Customer Support when initiating the return process. This information is required for the refund to be processed. The Customer will receive the refund after the product(s) have been returned and processed.
For additional information on the return process and refund times, please consult the “Exchanges and Returns” section of the website, as well as the help instructions in that section, following the instructions carefully to avoid unnecessary delays.
Order delivery times
18.1. Once the Customer's order has been registered, payment has been confirmed and all items in the order are available, Phone Safe will proceed with shipping, observing the following delivery times:
In mainland Portugal, on average, within a maximum period of 7 working days;
In the Madeira and Azores archipelago, on average, between 5 and 10 working days.
18.2. Phone Safe shall not be liable for any failure to comply with, or delay in complying with, any shipping obligation caused by a force majeure event, that is, an event, act or omission beyond its reasonable control.
Conditions applicable to Promotional Codes (discounts)
19.1. When used in accordance with the established rules, a promotional code entitles the Customer to benefit from a promotion or discount, relating to the purchase of a specific product or set of products, during the period indicated/associated with the promotional code/promotional campaign.
19.2. Promotional codes are personal and non-transferable and may only be used for online purchases made on the website. The sale, exchange, or donation of a promotional code is not permitted. The Customer holding the promotional code may not upload or make available a promotional code on any website or other public form of offer, donation, sale, or exchange. The use of promotional codes for commercial purposes is not permitted.
19.3. A promotional code may only be used once per product and per order. Promotional codes cannot be combined with any other promotions or special offers.
19.4. Promotional codes cannot be exchanged for cash and will not be reissued or refunded.
19.5. Without prejudice to any other rights, Phone Safe reserves the right to immediately invalidate the promotional code issued if it suspects that a promotional code is being used in violation of the above-mentioned assumptions.
Validity of promotions or commercial campaigns
20.1. Promotional offers or commercial campaigns advertised on the website www.phonesafe.pt are only valid for the time they are displayed on the website, and in accordance with the established conditions, unless otherwise stated on the website.
20.2. In the case of returning items purchased as part of commercial campaigns or promotions, the Customer will only be credited or given the amount actually spent on the purchase of the item they wish to return or exchange.
Responsibility
21.1. Phone Safe will only be liable for damages suffered by the Customer if such damages result from breaches attributable to Phone Safe's contractual obligations towards the Customer, or if the liability results from applicable legal law.
21.2. If the Customer has suffered damages related to the website's activity, Phone Safe's liability will be limited to:
Damage to products or other materials
The reasonable and verifiable costs incurred by the Customer to find the cause and the amount of compensation attributable to the damage;
The maximum reimbursement of the above compensation will be (if applicable) the price of the products in question.
21.3. Phone Safe cannot be held responsible for any damages suffered by third parties resulting from the use of any of its products, nor can it be held responsible for any damages suffered by the Customer as a result of improper use of its products.
21.4. Phone Safe is not responsible for any damages resulting from incorrect information on the website.
21.5. All products sold by Phone Safe comply with Portuguese legislation.
Trademarks and copyrights
22.1. All brand names, product names and titles used on the Website are trademarks or registered trademarks of Phone Safe or trademarks and registered trademarks of its suppliers.
22.2. The Customer or the User of the website are not authorized to use or reproduce any of these registered trademarks or registered names, as this constitutes a violation of the rights of the holders.
The Customer or User of the website is only authorized to electronically copy and print portions of the website if this is necessary to place an order, or to use the website as a source for purchasing.
The Client or User of the website is not authorized to make any other use of the website or the information and materials contained therein, including reproduction for purposes other than those mentioned above.
If the Customer or User of the website intends to use information or materials from the website, they will need to obtain prior written authorization from Phone Safe.
22.3. In everything that concerns the design, texts, documents, films, music and/or other services of the website, the selection and organization thereof, as well as the entire compilation of software (including applets) and all other materials on the website are the property of Phone Safe and its suppliers.
Applicable law
These general conditions and all disputes arising in connection with these general conditions, including their validity, the use of the website or any purchase made thereon, shall be governed by Portuguese law.
In the event of any dispute arising from the purchase and sale made with Phone Safe, through this website, the Customer has the right to appeal to CIAB – CONSUMER INFORMATION, MEDIATION AND ARBITRATION CENTER (CONSUMER ARBITRATION COURT) in Lisbon, to have the dispute between the parties resolved there.
Change of Terms and Conditions
Phone Safe reserves the right to change these General Terms and Conditions of Sale at any time. The Customer is subject to the principles and terms in force on the date of their order, unless the law or competent authority imposes any changes to them.
